This Privacy Policy (the “Policy”) describes RealThanks.com’s collection, use, and protection of the information users (“You”, “Your”) provide when using RealThanks.com (the “Site”, “We”, “Us”, “Our”). By using the Site, You consent to the terms and conditions of this Privacy Policy and to Our processing of personally identifiable information (“Personal Information”) for the purposes stated below. If You do not agree to the terms and conditions of this Privacy Policy, You must discontinue use of the Site immediately. Any terms that are not defined in this Policy shall have the meaning given in the Agreement.

The Policy applies to the Site where the Policy is posted, to subdomains of the Site, to any browser extensions and application add-ins providing the Services. This Policy does not apply to information that is collected offline or to any information that may be posted on the Site by third parties. We are committed to protecting your privacy. Thus, We only use Personal Information that You provide in accordance with the terms outlined below.

The Policy covers any Personal Information We obtain when You visit the Site, use Our Services, or access the features on the sites that We own or control (today or in the future), including https://www.realthanks.com/ (the “Sites”). You can access the Sites in many ways, including from a computer or mobile phone, and this Policy will apply regardless of the means of access. This Policy also governs the use of Personal Information We obtain from You from any third party site or application where We post content or invite Your feedback or participation, including, but not limited to, Twitter, Facebook, LinkedIn, Instagram, YouTube, Pinterest, and Google (“Third Party Sites”). We cannot control the privacy policies or practices of third party sites or of companies We do not own or control, and cannot control the actions of people We do not employ or manage. This Policy is subject to change at any time. However, We will treat all Personal information We collect in accordance with the Privacy Policy in effect at the time the information is collected. Your continued use of the Site following the posting of changes shall mean that You accept and agree to the changes.

The Information We Collect

We collect two types of information from visitors to the Site: (1) Personally Identifiable Information; and (2) Non-Personally Identifiable Information, such as IP addresses or cookies.

For users who optionally elect to connect to their email and calendars service, We will also use Contacts Information to assist Our service send to recipients.

Personally Identifiable Information is information that identifies You personally, such as Your name, address, telephone number, email address, or employer name. We collect and store the Personally Identifiable Information that You have provided to Us. During the registration on Our Site collect Your first and last name, email address and phone number. If You do not want Us to collect Your Personally Identifiable Information, please do not register an account with Us.

We automatically collect some Non-Personally Identifiable computer information (“Computer Information”), such as information about Your computer operating system (e.g., Windows XP, Mac OS), Your IP address, information about Your web browser (e.g., Internet Explorer, Google Chrome) being used, information collected through the use of cookies (see below) and information regarding Your Internet service provider. This Non-Personally Identifiable information may be shared with third parties to provide more relevant services and/or advertisements. Users’ IP addresses are recorded for security and monitoring purposes. Contacts Information is information that identifies Your potential recipients and includes information such as name, address, telephone number, email address, and interactions such as calendar meetings. We may, for example, connect Your Contacts Information only if You optionally connect and authorize Us to access Your Google account and/or phone contacts using the “connect contacts” feature.

How We Use the Information

We may use Your Personally Information for the purposes that include, but are not limited to the following:

  • to process Your orders, and to update You on the status of Your account and of gifts You have sent;
  • to deliver gifts on behalf of Our users;
  • to alert You to updated information and new products and services from Us, or third parties, or to forward promotional materials to You;
  • to allow You to share content and comments, if such functionality becomes available;
  • to allow You to upload content, if such functionality becomes available;

  • to optionally suggest recipients based on scheduled meetings in Your calendar, if You choose to enable these suggestions.

We do not sell Personal Information of Our users. We may disclose information about Our visitors, including Personal Information (e.g., e-mail address, phone number), when legally required to do so, at the request of governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing our Site and applicable laws, or to protect against misuse or unauthorized use of the Site. We may also disclose user information whenever We believe disclosure is necessary to limit Our legal liability; to protect or defend Our rights or property; or protect the safety, rights, or property of Our visitors or others.

We may use visitors' Personal Information for Our internal purposes of enabling visitors to enter one of Our online contests or sweepstakes, to subscribe to Our online newsletter or to inform visitors of upcoming events and special announcements. Each e-mail contains instructions on how to be removed from the subscription list.

We may use information about visitors, such as age, gender and interests for improving Our reporting on an aggregate basis and for targeting services tailored to specific visitors’ requirements. We also use it for market analysis. We may use this information to provide visitors with the most helpful products and services and to respond to inquiries.

We may store communication sent through the Site and/or resulting from Your use of the Services and/or the Site in any manner including, but not limited to use of any and all communication features. We may access and analyze such communications to improve the Services. We also use visitors' Computer Information to track usage, improve the design of the Site, offer products and services, to personalize Our visitors’ experiences, save visitors’ passwords in password-protected areas, and to ensure visitors are following the Site's Agreement.

Additionally, in the event that all or most of RealThanks Inc.’s stock and/or assets are transferred or sold to another entity, RealThanks, Inc. may transfer such information and information collected to the acquiring entity.

Cookies

RealThanks.com uses a software technology called "cookies." Cookies are small text files that We and certain third parties place in visitors' computer browsers to store their preferences. Cookies, by themselves, do not tell Us Your e-mail address or other Personal Information unless You choose to provide this information to Us by, for example, registering on Our Site. However, once You choose to furnish the Site with Personal Information, this information may be linked to the data stored in the cookie.

We may also use small pieces of code called "web beacons" or "clear gifs" to collect anonymous and aggregate advertising metrics, including, but not limited to counting page views, promotion views and advertising responses. Contests and Sweepstakes

RealThanks.com may occasionally offer contests and sweepstakes, which may be entered online. All the information collected by RealThanks.com is securely maintained and used only for the purpose of conducting and fulfilment of the contest or sweepstakes. Once the contest or sweepstakes are finished, We reserve the right to remove any Personal Information collected. The information collected through RealThanks.com sweepstakes may be passed to a fulfilment house which may use the information to help run the contest or sweepstakes. Any such fulfilment house may not use the information for any other purposes and must agree to maintain the confidentiality of the information.

Communications from the Site

We may want to contact You with information about Our deals, product announcements, software updates, new features and special offers. You have the following choices to opt out of future communications:

- You may respond to the email you received and request to be unsubscribed by including the word "unsubscribe" in the subject and/or message body.

- You may unsubscribe at any time via the unsubscribe mechanism at the bottom of each email.

Please note, however, there are certain emails We refer to as “system emails” (for example, emails confirming Your registration with Us, emails confirming Your change of password and other emails of this nature) that You cannot be unsubscribed from.

Collection and Usage of Information – Third-Party Sites and Affiliates

Our Site contains links to other sites including, but not limited to those of affiliates, advertisers, survey companies and gift vendors. We are not responsible in any way for the privacy practices or the content of these other websites. Visitors should consult the other sites' privacy policies, since our Privacy Policy does not cover those sites. We may disclose Personal Information to third parties who assist Us with providing the Services.

If You sign up for our Services, We may obtain limited information about Your payment card from Our payment processors. Currently, Our payment processor is Stripe. Stripe uses and processes Your complete payment information in accordance with Stripe’s Privacy Policy. Please be informed that We do not store any of Your credit card information on Our servers. The payment processor is responsible for storage of such information in accordance with its policies and procedures.

Security

We have adopted appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information We collect online.

You recognize and acknowledge that despite Our security measures, no data transmission over the Internet can be guaranteed to be completely secure, and no data is completely secure from an unauthorized third-party access.

Phishing: Phishing attacks attempt to steal consumers' personal identifiable information and financial accounts credentials. "Phishers" use 'spoofed' e-mails leading consumers to counterfeit websites designed to trick recipients into divulging Sensitive Personal Information such as credit card numbers, account numbers, nicknames, passwords, and social security numbers. WE DO NOT SEND EMAILS ASKING YOU TO PROVIDE OR CONFIRM SENSITIVE PERSONAL INFORMATION OR YOUR NICKNAME OR PASSWORD!

If You receive such email communications, please forward them immediately to Our Privacy Administrator at privacy@realthanks.com and then immediately delete the fraudulent email from Your computer.

We do not knowingly collect or solicit Personal Information from anyone under the age of 13 or knowingly allow such persons to use the Site. If You are under 13, please do not attempt to register on the Site or send Us any Personal Information.
